TERMS AND CONDITIONS FOR #LETSPLAYMAY JOE SWASH GAMING SESSION COMPETITION

1.     THE COMPETITION

1.1.    The title of the competition #LETSPLAYMAY JOE SWASH GAMING SESSION competition (the “Competition”).

 

2.     HOW TO ENTER THE COMPETITION?

2.1.    The Competition will run from 00:00 on 7 May 2018 to 23:59h on 15 May 2018 (the “Closing Date”).

2.2.    All Competition entries must be received by the Promoter by no later than 23:59h on the Closing Date. All Competition entries received after the Closing Date will be automatically disqualified.

2.3.    To enter the competition, follow either method:

2.3.1. Comment on Joe Swash’s competition Instagram (@realjoeswashy) post, or reply to his competition Twitter (@realjoeswash) post explaining who you like to game with and and explain why, also write the hashtag #LetsPlayMay. Follow Joe Swash’s social profile (@realjoeswashy / @realjoeswash) on the social network entered on so that the winner can receive a direct message.

2.3.2. Comment on the competition social post on social channel of the Promoter’s partner’s Instagram, Facebook or Twitter (2.3.2.1), explaining who you like to game with and and explain why, also write the hashtag #LetsPlayMay. Follow Promoter’s partner’s social profile on the social network entered on so that the winner can receive a direct message.

2.3.2.1. Promoter’s partner’s channels include, but are not limited to, the official Instagram, Twitter and Facebook profiles for the following companies: Amazon (@AmazonUK), Asda (@Asda), Argos (@Argos_online / @Argos), Games Centre (@GamesCentre.co.uk), GAME (@GAMEDigital / @GameStore), The Game Collection (@game_collection / @TheGameCollection) (Sainsbury’s (@Sainsburys), Morrisons (@Morrisons), ShopTo (@ShopToNet / @ShopTo.net) Tesco (@Tesco), TheHut (@TheHutcom / @TheHut_com), Activision (@Activision), Playstation (@PlaystationUK / PlaystationAccess), Ubisoft (@UbisoftUK), WB Games (@WB_Games_UK / @WBGamesUK)

2.4.    The Promoter will not accept responsibility for Competition entries that are not received for whatever reason.

2.5.    By submitting a Competition entry, entrants:

2.5.1. agree to be bound by these terms and conditions;

2.5.2. agree that by using the platform (Instagram, Twitter or Facebook) to enter the Competition entrants are also bound by the platform’s terms and conditions;

2.5.3. declare that entrants are the sole owner of the social profile used to enter the competition

2.6.    All Competition entries will be judged by a panel of judges and 1 winner will be selected based on the description in the entry.

2.7.    The decision of the panel of judges will be final.

2.8.    The judges will be selected by the Promoter and a list of names can be provided by request to the Promoter 15th May 2018.

 

3.     ELIGIBILITY

3.1.    The competition is open to UK residents who are aged 18 years or over except employees of Entertainment Retailers Association Ltd, and their affiliated companies, their families or agencies or anyone professionally connected with the Competition. The Promoter reserves the right to verify the eligibility of entrants.

3.2.    The Promoter reserves the right to decline any entries that are offensive or in breach of any applicable legislation or copyright.

3.3.    Use of false name or address will result in disqualification.

3.4.    In entering the Competition, entrants confirm that they are eligible to do so and eligible to claim the Prize.

3.5.    All entries must be made directly by the person entering the competition.

3.6.    Entrants may enter the Competition as many times as they like by commenting on alternative social posts.

 

4.     THE PRIZE

4.1.    The prize is a one-hour home visit experience including a game-play session with Joe Swash on a date specified by solely the Promoter. The winner will need to be available on the date and time specified by the Promoter in order to fulfill the prize. During the prize experience, Joe Swash will visit the winner’s house to partake in game-play with the winner using console games chosen and provided by ERA only. The prize also includes seventeen console games as listed in 4.1.1., on a format chosen by ERA and subject to format availability (“Prize”).

4.2.    The Prize is non-transferable and no cash alternative is available. The Promoter reserves the right to substitute the Prize for one of equal or greater value at its own discretion.

4.3.    In acceptance of the prize, the winner approves for the promoter, agencies, videographer, photographer and security to attend the winners house during the game-play session

 

5.     WINNER ANNOUNCEMENT

5.1.    The winner of the Competition will be notified on 16th May 2018 by a direct message on the platform and social profile by which they entered the competition (Instagram, Twitter or Facebook).

5.2.    The winner will then have 24 hours from the time of notification to respond via Instagram, Facebook or Twitter direct message to the Promoter by the social profile from which they were contacted, in order to claim the Prize.

5.3.    If a winner cannot be contacted or does not claim the prize within 24 hours, then the Promoter has the right to withdraw the prize and select a replacement winner.

5.4.    The decision of the judges is final and no correspondence will be entered into regarding the outcome of the Prize awarded.

5.5.    Confirmation of the winner will be available by sending a request and a self-addressed, postal-paid envelope to the Promoter at the Promoter’s address no earlier than 6 weeks after the close of the Competition and no later than 8 weeks after the close of the Competition. Only surname and county of the winners will be disclosed.

 

6.     LIMITATION OF LIABILITY

The Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize.

 

7.     DATA PROTECTION AND PUBLICITY

The winner of the Competition agrees that the Promoter may use their name and disclosure of county of residence relating to any post-winning publicity. The winner agrees that photography and videography will be captured in their residence during the game-play session with Joe Swash featuring the winner and any direct family members who the winner selects to join the game-play session. The winner agrees to sign a photography and videography release form and that said photography and videography can and will be used by the Promoter and partners for publicity, social media, marketing and promotional purposes. In administrating this promotion, the Promoter will not collect more of the winner’s personal information than absolutely necessary and will only use the winner’s personal information for the purposes of this promotion

 

8.     GENERAL

8.1.    The Promoter reserves the right to terminate, amend or extend this competition in the event of exceptional circumstances outside its control, which affect its ability to operate the competition.

8.2.    These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and the courts of England shall have exclusive jurisdiction in relation to any disputes arising therefrom.

In order to administer the Competition, the Promoter may make use of advertising and promotional agencies (“Promoter Agents”).
